Re: ask to leave before probation period ends

hi

i would like to know whether the manager has the right to force a probation staff to leave and bugg the staff to get a job ASAP even when the staff were only there for a month plus? and also to change the position as she like it?

That staff can tell her to sack him instead.

you are saying get the staff to talk to the manager to sack him? if requested by the staff, the company wont pay him any compensation right?

You said the manager forced the staff to leave. The staff can say: I wont leave, sack me lah. When the staff got the sack, the staff can then complain to the Labour Department or the IR Department. If the staff leaves on his own , he may not be able to complain.

If they sack him with a reason, will still he get the compensation?

That may be their reasons but the staff can disagree and can still complain. Whether the staff can get compensation or not is a question to be decided by the authority.

termination will be valid only with a termination letter, right?
if verbally, does it count?
or can they back date the termination letter?

1. Notice must be in writing.
2. It still counts but the problem is, disputes can arise. You may not know who is telling the truth, who is not. Best be in writing.
3. Cannot be backdated.
