Re: Overtime calculation

My company told me, if I do ot, calculation not base on my salary. If my salary over 2000, the ot rate will fix to 2000 to calculation. That mean I got 2500 salary , but ot calculation is base on 2000.
Is it company do that is illegal? Can us sue the company?

Then you are not covered by the Employment Act as your salary is more than 2K. So, I don't think it is illegal for the company to use 2000 for OT calculation. However, you can negotiate with the company if you think their method is unfair.

If company dont give me claim ot, is it not illegal too? if salary over 2k not covered by the Employment Act, so who will protect us, if we facing unfair situation?

What you can do is to refuse to work overtime for him, that's all. Besides that, there is nothing much you can do about it. Anyway, you can give a call to the Labour Department see whether they can give some official suggestions.
