你好!我公司一直以来都有在使用KPI的方式去监督员工的工作表现,同时也依据KPI的表现给予适当的调薪。最近公司想要通过KPI加强赏罚分明的观念,认为员工KPI表现好就可调高薪资,所以当KPI表现不好自然也可以降薪,但不确定是否会抵触劳工法,所以特来询问一下,谢谢!

p/s:调薪/降薪的KPI是依据季度KPI来决定的,三个月内有两个B-或一个C就会在下个季度调降,最低不会低于appointment letter上的数字。

i had called JTK yesterday regarding the same issue, the answer is NO, any deduction from employee is not allowed inclusive allowance, even no mention in contract. If really want to deduct from wage, must get approval from JTk with supporting document.
