Hi,

Annual Leave
8 days for 1st year service
12 days for 2nd to 4th year of service
16 days for 5th year of service and above

Termination Notice Required
4 weeks’ notice if the employee has served for less than 2 year
6 weeks’ notice if the employee has served for 2 years or more but less than 5 year
8 weeks’ notice if the employee has served for 5 years or more

Question,
1) If staff join on 1/7/2015 until 30/9/2016, how many days annual leave for 2016 and how long termination notice required?
2) If staff join on 1/7/2012 until 30/9/2016, how many days annual leave for 2016 and how long termination notice required?

Since you are aware of the law, what is the problem? Just count accordingly.

Now I have problem of Question 2, for my knowledge, I should have 4 days ((30+31+30)/365*16 days) because I ready finish 4 years’ service and just need 6 weeks’ notice for termination notice because I just work less than 5 years. But the management say that I just have 3 days ((30+31+30)/365*12 days) with need 6 weeks’ notice for termination notice. And if i wants 4 days annual leave, I should give 8 weeks’ notice for termination notice. Now I am very confusing.

You will not go wrong with 6 weeks notice. No confusion there.

Actually I join this company on 29/05/2012 and submit the resign letter on 21/07/2016. With 6 weeks’ notice my last day should be 01/09/2016. Due to our AL is accumulated; I still have 3 days AL 2015 and 9 days AL 2016. After deducted my 12 days AL with approved, my last day on 17/08/2016. Yesterday I just received my salary but not until 1 month. And they refuse to pay me 1 day (01/09/16) AL, they give me reason of notice of terminate. How should I do? Can I claim back?

You can go to the Labour Department to claim back whatever due to you. You should go there in person.
