请问如果员工做少过1年而且还没confirm的话是没有annual leave对吗? 通常是unpaid leave的.

除非公司confirm了(就算少过1年), 就可以享有annual leave.

虽然员工还没confirm, 老板还是给他拿annual leave, 可是服务满了一年就要扣回之前的.

Confirmed or not confirmed, one must complete 12 months service to qualify for paid annual leave. If the boss wants to grant paid leave before 12 months service, it is OK. You better read up the law. Read Part 12 of the Employment Act

Referring annual leave matters.
This staff joined 02/01/2016 undergo for 6 months probational period.
If this staff tender her resignation on 30/05/16 and served one month notice as per employment contract.
Does she entitle for her annual leave to off-set her notice?
How to calculate her last day and last physical working day with her company.
