一个员工做了1年多可是老板迟迟不confirm. 所以他请假都是unpaid.

根据labour law 60 (E), 就算没有confirm, 如果连续服务了12个月就会有8天的有薪假期,对吗?
但是他的appointment letter里是写如果confirm了会有14天的有薪假期, 请问应该要跟哪一个呢? 8天还是14天呢?

之前她请的unpaid, 需要补回给他吗?

未confirm之前但工作超过12个月你应该可以享有8天年假。之前拿的无薪假是应该补回给他的。

意思是跟labour law里的8天而不是appointment letter里的14天?

她是2014年9月进工, 那么到2015年9月有8天年假, 2015年10月到12月的话是多2天(3/12X8).

如果她的unpaid多过10天的话, 也是只能补回10天而已, 对吗?

Her appointment letter didn't mention about confirmation is how many days.
It written as "Your Annual Leave entitlement is 14 days if employed by us for less than 2 years."

Besides, in our handbook, probation period is 6 months and maximum extension is another 6 months only.
So total probation period is 12 months. But now she works more than 12 months already, is it meaning auto confirmation?
Because our boss still no answer about her confirmation.

Please advise.

I would suggest that you personally go to the Labour Department, sit down with an officer and discuss the issues with more details.
