Re: Overtime to late night

Good day Sir

I'm working as a supervisor in construction field. Sometimes we need to work till the late night about 4 am to 5 am to the next day.

Example, Punch in to work at 1/3/2016, 8:00am , Punch out at 2/3/2016 4:00am.

1) In this incident , do i entitle for off day on 2/3/2016

2) Due to insufficient of man power , i need to come back to work on 2/3/2016, 1:00pm and punch out at 3/3/2016 2:00am.

In this case, how should i calculate my over time hours for 2/3/2016? My normal working hour is from 8am to 5pm.

1. There may not be off day but must pay overtime for it.

2. In my opinion your working hours are way too long and they should pay you overtime wages for all the hours after your normal working hours.

i felt that employee need to be treated fairly, and some form of compensation need to be considered for working extra hours.

The question is :
If the employee is not covered under the labour law, can he use the labour law to calculate his overtime?
