Hi Mr.Siew,

May I know what is the differences between formula as shown below.

1. Monthly Basic Salary / 26days
2. Monthly Basic Salary / 30 or 31

If we choose formula 1, so if staff taken unpaid leave, we shall also divided by 26days, am I right?

Please advise.

1. is the formula for calculation of overtime, annual leave etc etc as mentioned in Part 12 of the EA and the formula is in Section 60i. Check it up. You cannot use 30 or 31.

2. is normally used for salary calculation or unpaid leave. If you want to use 26 or other methods, it is up to the company.

For formula 2 - is that any labour law issue if the company using 26, it mean that can the employee go lodge complaint to labour office.

Pls advise.

He can if he wants to. Let the Labour Department decide or you can also give a call to the Labour Department and get their opinion.
