Dear Mr. Siew,

Hi, we have 1 staff still have 16 days of annual leave which will not carry till 2016. He has given the option to carry to 2016 or we will reimburse it and he wish to receive the money.

Could you please advise how to calculate his pay?
His pay is RM2500 is 2014(10 days) and RM3000 in 2015(6 days).

You may use the formula (salary/26) x number of annual leave.

Meanwhile, i'm confusing about 26days and 30days in the salary calculation. Could you please explain on this?

One of the staff is taking unpaid leave of 2 days, from the salary, i should minus the sum(2/26x2000) or (2/30x2000)?

As for unpaid leave, there is no formula for it. It is up to the employer to use whatever formula he wants.

在不遲過十二個月的不斷服務后,雇主必須在不遲過十二個月內給和雇員必須拿年假.若雇員在此期間沒有拿年假將失該年假享有權;

不過,在雇主要求下而雇員也同意不請年假,雇員有權得到補年假的款項.

The employer shall grant and the employee shall take such leave not later than twelve months after the end of every twelve months continuous service and any employee who fails to take such leave at the end of such period shall thereupon cease to be entitled thereto:

Provided that an employee shall be entitled to payment in lieu of such annual leave if, at the request of his employer, he agrees in writing not to avail himself of any or all of his annual leave entitlement.
