If offer letter is mention that Female employers are granted 60days maternity Leased upom completion of at least one year service, which menasihati to conceive after one year. Those Who work less than one year will not entitled to have maternity leaves. (I.e. Female employee required to work 1 year and 9 months to entitled for maternity leave). The letter is valid?

If the employee accepted and signed the letter and work less that a year. the employee entitle claim for maternity leave with salary? thank you

That condition is the offer letter is not valid. Even if the employee signed the offer letter, the employee still has the right to claim maternity benefit because the clause is not valid.

TQ. If the employee haven't get confirmation letter. Employee still entitle Maternity benefit?

She is entitled to it as long as she is covered by the Employment Act which only covered non manual employees with salary not more than RM2000. If she is not covered she better to try negotiating for a fairer deal as the Labour Department may not be able to help her.
