Re: Withhold Salary

Hi. I have tendered my resignation on 8th February. I am providing 1 month notice period as per employment agreement thus my last day will be on 7th March. One day before pay day for February, I have received email from HR that they my salary for February will be withheld as my last service date falls less than 14 days of the last serving month.

I can't find any existing company's policy on the matters. Do they have the right to do so? I don't mind if they delay in paying my salary for March, but why do they hold my salary for February? Can I fight for my right on the matters? Please assist me.

How can they pay you your February salary when the month is not over yet? I don't think I understand what is it all about.

They always make the salary payment on the 23rd or 24th of the month. But they already email me that I'm not gonna receive my salary for February. They will hold my salary for February and March until my last day or 12 days after my last serving day. They said they will only pay both of my salary once they have received the completed EXIT Clearance Form and handover notes which I can only submitted on my last day.

I am not happy on their decision to hold my February salary. If they are worried that I will just leave the company without proper handover than they can hold my March salary but not my February salary

In the case, I think they are right to pay all salary due to you on your last day ie 7th March. Consult the Labour Office if you wish.
