Dear Sir,

I am from retails line company. My promoter salary pay base on basic, commission & overtime. But now she was resigned, and company was hold her salary due to a stocks lost case. Regarding this case, can us just release her basic wage & overtime pay? Not pay for the commission, because she is the one who responsibility to take care of the stocks. kindly advice.

If she agrees, there may not be any problem. Not know what sort of stock control system you have, It is really hard to say who is really wrong.

But if refer to her appointment letter we just state basic salary. If she is going to labour office and we only agree to pay her only her basic salary & overtime, is there any problem?

I don't know. Labour Office may investigate deeper and may not just look at the appointment letter. Anyway, if you cannot settle the matter with her amicably, then just let the Labour Office deal with the case should it reach there.
