Re: Pay leave after resignation

Hi

I have tendered my resignation letter on 11/8/2014 which my company required for 3 months noticed. My last day shall be 11/11/2014 and I have balance of 15 annual leave and 13 replacement leave as at my last day of 11/11/2014.

My actual last working day is 30/9/2014 and clear the balance of my annual and replacement leave and 2 public holiday on (6/10 Hari raya Haji and 23/10 deepavali) until 11/11/2014 which mentioned clearly on my resignation letter. 2 weeks before my last day I have emailed HR manager and my boss on the replacement leave and annual leave details and they have no issue with that,

However, I do not receive my salary on 1st Oct which they normally pay on 30 of the month. I called HR and they told me they forgotten my payment and will bank in it immediately. However, I only received the payment on 7/10/14 and it is not in full month salary. I called the HR manager, and she told me I am not entitled to clear leave and enjoy the public holiday. They only pay me the total leave balance from my salary.

Even so, the payment i received is not enough for 28 days of leave.

Can anyone please advise me what should i do?

You can of course bring the matter up with the Labour Department about balance of annual leave. But I am not sure whether they will look into the issue of replacement leave. You have to go there personally to lodge the complaint.

Hi KL Siew, thank you for your info. what about the clearing leave and pay leave. Can I do anything with that as now only they inform they down accept leave clearance but they have accepted my resignation letter and my lasxt day is 11/11/14. Please advise.

For that you will have to approach the Labour Department and let them look into it and decide.
