Hi Mr Siew,

My company(A) intended to transfer 1 lady packing worker to our subsidiary company(B). The reason is because Company A already closed down their packing section. Other section is not suitable for her. Fyi, Company(A) is running its business as trading of motorcycle accessories whereby Company(B) is running business of beauty products.

Can Company A transfer this worker even she is unwilling or is there any dispute of the transfer. The following clause has included in our letter of appointment to this worker as shown below.

'You will be required to work in any departments or any other places of work or any associated companies on duties as may be allocated to you. You may also be transferred to or from any of these departments as per Managementís discretion'.

Please kindly advise.

In view of that clause, the company may be right especially A had closed down. She might be hoping to get termination benefit. But I am not so sure whether she is entitled to it since the company has offered her alternative employment. You may refer to the Employment(Termination and Layoff Benefits)Regulations for details about entitlement.
