I have a staff who have been absent from 24 Aug 2014 until 8 Sept 2014. We have issued him with a Show Cause letter and he replied and thereafter he came by to the office to explain of his absent. His reasons given to the Company was. headache, purging and he went for traditional treatment.

I have explained to him that he had terminated his own contract of employment with the Company and if he want to come back to work, I told him that I will have to do a Domestic inquiry on him and the final result will be termination (because he had already terminated his own contract).

As such, he said he will tender his resignation, but uptill todate, he have yet to tender his resignation.

Question. Can I terminate him by applying Sec 15(2).

You have to be firm in whatever you want to do. If you want to conduct a domestic inquiry do it quickly. As it is now, if he has already come back to work and you allowed him to do so, it seems you have condoned the offence. I think this time if you want, you give him a final warning. If he goes absent again, suspend him from coming back to work and then hold a DI and sack him.

If he is still absent, conduct a DI and decide. Inform him the date and time of the DI and ask him to attend without fail.

He did not come back to work. After that day he came by to see me and he told him immediate superior that he will tender his resignation but I have not receive any letter from him.

If he had not responded to the Show Cause then I can terminate him under 15(2) but the problem now is that he replied.

Just fix a date for the DI and decide.
