Re: Resignation of hold salary

Dear Sir,

I need a help,

1. I resign from my current company from 25 June with serve 2 months notice, the last day should be 25 August or 24 August?

2. My HR said will hold my last month salary about 2 month for Pay LHDN. is that rite?
MY HR wrote as below.

For resignee we will need to do a tax declaration with LHDN (tax office) to ensure your personal tax is cleared. Thus, we will on hold the resignee’s last month salary just in case there’s some outstanding amount with LHDN, if no then the LHDN will issue a letter to said that we can release the payment. Once we receive the letter then will Proceed to release the withholding last month salary.


Please advice me, because we need a money to survive if they hold our pay for 2 months.
can we disagree?

1. Your last day is 24 August.

2. I don't know much about your company's tax procedure. I think if you need to expedite the matter, you can personally go to the LHDN office to settle your tax matters then and there. You don't have to depend too much on the company to do it for you.

would like to check the resign date is fall at holiday.

My HR told me, the resignation notice is 2 months, means is 60 Days, i give the letter is 3 July 21 , suppose is 2 Sept 21, But HR told me is 60 Days means my Last days is 31 August 21, May i know actually the 60Days is include the holiday ? means the company not going to paid us back for the holiday leave ?
means for 31 August is not going to paid back by Annual Leave ?
they should paid back or not suppose to paid back ?

If the notice period for termination of service is 2 months and not 60 days. Your last day should be as you said 2 September. 2 months does not mean 60 days. Give a call to the Labour Department and talk to one of the officers there to get an official ruling.
