Re: 被雇主不合理無證據的解雇

本人在Fxx Cafe 就職兼職,在8 Apr 2021
本人whatapps 收到了雇主的解雇信,當時本人處於莫名其妙的被解雇,想要詢問雇主信上所提出的解雇原因和證據,以及雇主違反了雇用合約第10條,『『TERMINATION During your probation, either party may terminate this Contract by giving to the other a 24-hour notice or salary in lieu thereof. Thereafter, your employment may be terminated at any time by either party giving to the other no less than 2 months' notice in writing or paying to the other two (2) months' Remuneration in lieu of such notice.』』,本人也希望得到合理的解雇證據,本人也尊重雇主可能需要時間去準備資料,本人也給予雇主一個星期的時間,到期限也沒得到雇主任何回應,本人再次給予雇主三天時間,如再無任何回應,本人將此事交給勞工局處理此事,以合理合法的為雇員得到應有的賠償,是否成立

雇主還利用加薪合約,設下每位員工都需要執行的紀律,而我卻並列為條件以及本人認為是建設性解雇(constructive dismissal )


以上雇主說提出的解雇原因,本人不知道何時犯下的錯,也沒有當下告知本人,本人原本想詢問雇主此事,雇主卻不做出任何回應

Yes, since there is no response, then you should bring the matter up with the Labour Department (Jabatan Tenaga Kerja) and let them look into the matter. You must go there in person to lodge the complaint.
