你好,有事请教。

我是在一家game shop工作有十年了,三年前旧老板把店顶卖给新老板,附带连员工也保留。

现在问题来了,一直以来旧公司都没有提供appiontment letter,都用口头讲薪资及佣金的数额,新老板接手后也是说conditions全部照旧,没有更改。

但在八月底会计部的小姐突然告知我老板有发appiontment latter给我,告知我的新薪资,工作范围,最可笑的是居然不肯把我列为已confirm的正职员工。

鉴于他发觉我的工资比其他分行的“新进”员工高,他直接cut我的allowance 400,只留底薪1300,并注明我不得享有年假&病假,上班时间照旧, 一个星期工作4天 (10am~10pm),如果超时工作或公共假期有做的话有补钱但是没有列下数额及工作时数,而且还要我同意倘若有天离职,2年内不得做回相同行业。 请问我是否有权不接受他的offer? 其实我知道他是有意向我开刀,因为之前也有他自己的老员工相续被他裁走,

其实这位奸诈的老板也有“不小心"少付我ot钱将近一年,刚好在上个星期被我发觉跟吵后再给要回来,算起来将近2千块咧。 这种行为可否列为诈欺罪呢?

看来你的老板违反了原有工作条件。你还是拿那新appointment letter亲自去劳工局一趟了解了解你的问题。

谢谢你提供意见。 我尽量尝试再跟新老板沟通一次,倘若他真的再耍太极的话,唯有真的跟他“翻脸” 。

Siew, 你好!

我已经尝试跟我老板沟通过了,最后他有稍微更改了condition, allowance有补回给我,但是信件内容依然还有盲点 :

1. 信件抬头 : offer letter,
2. 没有注明已是正职员工,
3. 依然不肯注明 ot 钱的算法 & 工作时间,
4. 不能享有病假 & 医药费,(年假方面我妥协,因为我的工作时数长,日数短),
5. 佣金方面依然不肯列出计算方式。花红方面已确定是“冻过水”的了,因为会计小姐有私低下告诉我老板将打算waive掉我来年的花红。

照可情况来看,大致上应该是老板想省回一笔layoff 钱而做的动作吧。
您认为呢?





RE : OFFER LETTER.

We are pleased to offer you the position of Sales Executive in the retail sales job division of our company with the following terms and conditions :-

1. Your commencing salary is RM1,300.00 based on 16 days per month. You are entitle for extra day pay for any additional day work after 16 days.
2. You are entitled for public holiday pay in accordance to company 11 gazetted holiday in one calendar.
3. Working time is from 10.00am to 10.00pm on every working day.
4. The company will contribute to EPF and Socso based on RM1,300.00 basic pay, in accordance to labour law.
5. You will be entitled for monthly allowance of RM400.00.
6. You will not be entitled to any annual leave or medical leave.
7. The company may pay out bonus based on your performance and company’s profitability.
8. Your job function is to do sales and assist in smooth business sales. Incentives will be given based on the incentive scheme.
9. You cannot divulge to any person or company directly or indirectly any information or knowledge concerning the affairs, trade secrets, business activity of the company and that of the company’s client.
10. You agree not to work or be involved acting as partner or otherwise in the home video games business for a period of at least two years after termination from this position in Mid Valley City Area.

1. Looks OK since you work only on 16 days per month unless you think otherwise. If the total working hours per week exceed 48 hours, then you will be entitled to overtime.
2. This one is OK.
3. As mentioned in 1, if the total working hours exceeds 48 hours then there will be overtime.
4. You can consult EPF and SOCSO whether the allowance of RM400 should also be included in the contributions.
5. As in 4.
6. This one is not OK.
7. This one is OK as the bonus is not contractual.
8. Nothing to comment. You can find out yourself that incentive scheme.
9. Nothing to comment.
10. Nothing to comment.

Consult the Labour Office for another opinion if necessary. Bring along the contract.

epf & socso坚持只支付底薪,
病假依然不给 (虽然我不曾拿过病假), 医药费却只是口头答应,一年rm400为限,不会列在信件。 理由说我已经有很好的福利。

我认为你最好还是将问题交给劳工局, EPF, SOCSO 处理来得一个官方的意见。这样会比较在这里讨论有效力。

公司不可以出 RE : OFFER LETTER
必须注明是 RE: LETTER OF APPOINTMENT
否则可以说这是给你的优惠

在签名前必须肯定:

公司名字是否是公司注册的公司?
一般进EPF给你的那间公司就是公司真的公司名,地址也必须确认
地址是否是公司的地址?
通常公司会加
