An employee who have been working for more than 10 years with the Company and on one particular occasion when his Superior called him to standby to prepare to change a machinery part when the production line stop, he refused by saying that he is not free. After calling him repeated over the loudspeaker, still did not show up, the Superior together with another technician proceeded to carry out the repair work. Suddenly the Superior saw him and called him over to help....he just stood by the side and a few second... he shouted at his colleagues to move aside and while he is helping out he uttered some very rude remarks towards his superior and his Assistant Manager.

Question : Can I suspend him for 5 days without pay as a form of punishment without any DI being carried out on him ?
This employee is an Union member.

Please advise.

DI should first be carried out. Refer to Section 14 of the EA for guidance.
