Re: Extension of Probationary Period

I have signed an agreement for a fixed term contract from 16 June 2009 to 31 July 2011. Subject to a probationary period of six months, within which time, I am supposed to undergo training leading to a certificate qualification relevant to the job.

My probationary period was supposed to end on 15 December 2009.

Just last Friday, 5th February, 2010, the Principal gave me a letter entitled "Extension of Probationary Period". This letter was dated 15 December 2009. The extension probationary period was for another six months starting 15th December.

The reason he said they were extending my probationary was because they did not have the time to send me for the training.

The question now is:

1. Am I bound by this new extension probationary period?
2. Can a company at its discretion, only put in a clause to terminate my service during the probationary period, make no mention of extensions and yet, again at its sole discretion extend my probationary period to what amounts to the duration of a year?
3. Can the Industrial Relations Court do anything?

I don't think the Industrial Relations Department can be of any help. However, you still can consult them if you wish. Although the reason for extending your probation is rather unusual, the good thing is it was not because of your performance. So, just carry on your work as usual for the time being.
