Hi Sir,

A Store Supervisor, his basic pay is more than RM1500 (date joined Nov 2009). He met an accident on 16/8/2010, till todate still coma condition. we have submitted the socso claim. His leave records as of 3/8/2010 as follows:

1) sick leave taken: 8 days
2) Annual leave taken: 2.5 days
3) Sick leave 4/8/2010 till 14/8/2010 due to mosquito illness
- Sick leave came to worked without consent of employer
i) 4/8/2010 = worked for 0.5 day
ii) 10/8/2010 - 12/8/2010 = 0.5 day
iii) 14/8/2010 = worked for 2 hours
4) Sick leave 16/8/2010 till 1/3/2011

Company has paid him full paid in August & September 2010. We have recorded his leave as follows:
a) 4/8/2010 - 9/8/2010 = 6 days Sick leave
b) 10/8/2010 - 30/8/2010 = Hospitalisation Leave (21 days)
c) 1/9/2010 - 30/9/2010 = Hospitalisation leave (27 days)

My question is how long do we need to pay to this employees?

We decided to pay the October salary as follows:
- 1/10/2010 - 12/10/2010 = full wages
- Balance annual leave as of 12/10/2010 = 3.5 days (6.24 - 2.5days)

I think you should get SOCSO to speed up the temporary disablement payments instead of your company keeping on paying the employee. Consult SOCSO.

get advice from socso office and labor office on this will be the best solution.
Check with his report how he met the accident if lumba haram he is not worth to be paid a sen is like suicide his self does not value his life and the company
