Hi Siew,

if a part time worked on Public Holiday for 5 hours. RM3 per hour. His salary calculation is RM 5.00 x RM 9 (Triple) or 5 hours equal to one day pay like those monthly worker.

For part time worker, RM3 x 5 (h) x 2 = RM30 for that day.
The "2" is a new standard formula for part time worker under the regulation.

Not knowing the facts, I am not sure what you meant by "part time worker". He may be just an hourly paid worker. I tend to think he should be paid 3 times. By the way, there was an announcement by the Labour Minister today about part time employees to be covered by the EA. Not sure what was it all about. Consult the Labour Department if you think necessary.

EMPLOYMENT (PART-TIME EMPLOYEES) REGULATIONS 2010

Regulation No. (6) If a part-time employee is required to work beyond his normal hours of work on paid holiday, he shall be paid for such extra work at the following rates:

(a) not less than twice the hourly rate of pay for each hour or part thereof
which exceeds the normal hours of work of the part-time employee;
and

(b) not less than three times the hourly rate of pay for each hour or
part thereof which exceeds the normal hours of work of a full time
employee employed in a similar capacity in the same enterprise.
