My employer came up with this clause that says "You're not to resign within 365 days" without stating the implication. I asked him wad the implication was and he said to pay back the training cost. After 1 month i decided it was not suitable job for me (they confirmed me on day 1) and upon resignation, he said he'll sue me for the remaining bond time and additional manpower costs etc. I said you've said i only needed to pay back training cost to which he replied "dun put words in my mouth".

So can he really sue me? the clause is an additional sentence in my offer letter.

Don't bother with that clause. Let him sue if he wants.

in addition, The contract also mention " after the contractual period stated above, unless otherwise reviewed either party may terminate employment at any time by giving the other 3 months' notice in writing or 3 mths in lieu.

does the 3 months mean only after the contractual period or it applies before as well..

It looks like that. If it did not mention the notice period for termination before the contractual period, the required notice is 4 weeks as mentioned in the Employment Act.

okok thanks for the information!

Could I also ask, if he sues me, that would me going to the industrial court? I'm only a fresh grad but he said he "guarantees that he'll sue me if i leave"

Worse to worse I'll have to go to court to settle? Will I need to engage a lawyer?

Do you recommend me to go to the labour department for this?

If you are still worried, you can consult a lawyer by showing him a copy of your contract with the employer and get his views.
