Hi, Would like to seek your advise for the below case:-

A staff has tender her resignation on 30/8/2010. On 1/9/2010 - 3/9/2010, she informed us that she is on MC. After that no more news from her until she send us sms on 8/9/2010 at night she will be in the office on 20/9/2010 til end of the month.
Can we on hold her salary according to sec15(2)?

She will have .to pay the company .indemnity for the number of days she was absent. Yes, I think you can do that by withholding her salary.

If we wanna ask her to leave on 20/9/2010 due to no show and improper inform to management? Do we still have to pay her the salary? Please advise.

Obviously, she may be hoping that you will do that so that she will not have to serve through the entire notice period. I also don't think she will show up after 20/9. For me, I will wait and see. If she does not work through the entire notice period, then I will claim indemnity against her.

However, the mgmt would like to ask her to leave even if she wnts to stay til end of the month by not paying her salary.
would like to double confirm with you.....can sec15(2) apply to this case???
