Re: resign letter

If an employee wish to resign after 4 years with a one month notice starting from 25 Jan;
(i) when will it be her last day?
(ii) can she carry forward her annual leave - to be minus from her one
month notice period?

1. Last day should be 24 Feb

2. She can do that.

I need help on this as I have no idea that we can minus balance annual leave in our one month notice. Never faced with this kind of situation before. We doesn't really have HR department in our firm as it is a small firm and as I'm the admin clerk, my boss instructed me to find out about it soon. My boss is not good with labour laws either. That girl wants to leave on the 12 Feb... (even we really don't mind with it) is it right to do so? What are the choices we have as an employer?

Thanks for your reply Mr. Siew. By the way she got balance of 6 days from previous year. She joined our firm on June 2006.

Section 60E(2A) of the Employment Act may be helpful to you. Note the words "..the employee shall be entitled to take before such termination takes place the paid annual leave...."

"(2A) Notwithstanding subsection (2), upon the termination of an employee's contract of service, the employee shall be entitled to take before such termination takes place the paid annual leave due to be taken in the year in which the termination takes place in respect of the twelve months of service preceding the year in which the termination takes place, and, in addition, the leave accrued in respect of the completed months of service during the year in which the termination takes place."

Dear Mr. Siew,

Earlier in 2009, she took one and a half month unpaid leave. Starting from 1/12/2009 until 15/1/2010. She came back on 18/2/2010 and gave her resign letter on 25/1/2010. How do we calculate her salary now? We have paid her 1/2 month salary on 1/2/2010 for January 2010, if she leave on 12/2/2010, how do we pay her? Please advise. Generally, a
one month notice sholud serve 30 days or 31 days?

To me, she should be paid up to 24 Feb. If she agrees to accept half month's pay, it is up to her.
