Re: Hospitalisation Leave

Dear Mr Siew,

If an employee (date joined 20/5/2008) admitted to hospital on 4th August & discharged on 5th August, subsequently Doctor issued sick leave from 4th August till 1st September 2010. This employee has utilised total of 4 days sick leave (Jan 2010 till 3rd August 2010). Her working day is 5 per week (sunday is rest day). We decided to treat the sick leave as follows:
1) Hospitalisation leave : 4th & 5th August 2010
2) Sick Leave : 6th till 19th August 2010 (14 days)
3) Hospitalisation leave : 20th August till 1st September 2010

a) My question is whether the above is lawful?
b) Is the calculation on the above correct? sick leave / hospitalisation were count included Sunday & Public Holiday.

1) Hospitalisation leave : 4th & 5th August 2010, this is correct
2) Sick Leave : 6th till 19th August 2010 (14 days), this period can include Sundays but excludes public holiday if there is any during the period.
3) Hospitalisation leave : 20th August till 1st September 2010, if the employer is willing to to treat this period as hospitalisation with pay, he is quite generous.
Just bear in mind, Sundays are included but public holidays are excluded.
