Re: Compensation of contract of service

I m entered into 1 year contract of service which stated the termination clause as follow:-

1) Termination by employee have to give 1 month notice and compensation of RM2k as a training provided by employyer.
2) Termination by employer only give 1 month notice

My question:-
1) May basic salary below RM1.50k, under Employment Act sec 7 do the above contact consider no effect as the term & condition above favarable to employer?
2) Training provided by employer is general & only half a month.

It looks to me the compensation is a separate deal which may or not be fair to you. You can protest to your employer about the "raw deal".

What if I challenge in labour office, do this arguement sufficient enough challenge the employer on the letter offer?

You are not in their employment, and if the risk is too high for you, reject the offer.

I think the approach should be if the employer asks to pay up the 2K, you will refuse to pay because the training given was not worth the amount. You will then challenge it this way. If you have already resigned and the employer is asking you to pay, you just refuse to pay that\s all because the training did not justify the amount.

Says if I really challenge them with unjustify training...do the labour office really help me??

You don't challenge anything when you are not asked to pay. Wait for the employer to take action to sue you to recover the money, then you challenge. It is then up to the authority to decide who is right and who is wrong.
