Re: enforce compulsory annual leave

I would like to clarify whether employers can require their employees to take compulsory annual leave due to business closure in view of the upcoming CNY festive celebrations?

I suggest you complain to the Labour Department if you are not happy with that arrangement.

Since you don't want the leave, I don't know whether the Labour Department will get the employer to let you have something to do during the period of closure. Consult the department see whether anything can be done to help you.

Good afternoon, if the management can justify the need to declare a certain day/days as compulsory annual leave, can the Labour Department interfere and overule such a decision and what abt those who may not qualify for annual leave. Are they to take unpaid leave

Whenever there is a festive season, this problem always crops up.I don't whether the Labour Department will interfere or not. There will be complaint whether leave is granted or not granted. One way may be to negotiate with the employer for a compromise say, if the closure is 5 days, workers will take 3 days leave instead of 5 and for those not eligible for leave, 3 days will be no pay, not 5 days. As in previous years, I used to advise that we follow the majority. If the majority of the workforce has no problem with the arrangement, just follow and have a nice holidays with friends and family during the festive whether it is CNY, Hari Raya, Xmas or Deepavali.

hi, as for this issue, employment act does not have relevant clause to deal with it. so this is the loophole of the act and the employer fully utilise it as such decision to have compulsory annual leave is not against the law. is there any comment from labour office? my company declare compulsory annual leave as well, however, it is meant for the company trip and annual dinner. as an employee, my concern is, this is company related events and the employer should not do so. however, as the act does not specifically address the issue, the employer continues this practice.
