Usuallly my company pay the salary by end of the month without fail. Today in the meeting, my GM asked the HR Department to delay staffs salary by the 7th day of the following month. He was not happy of staffs performance and wants to penalise the staffs by delaying staffs salary.

My question is can the company do that? Section 19 in the employment act did mention wages to be paid not later than the seventh day after the last day of the wage period. But my company do not have any problem in the cash flow at all. How to justify tto the staff? This will surely effect the staff moral and surely effect their productivity.

Does it affect the entire staff of the company or only certain section of the staff? Anyway, discuss it with your own HR Department.

Dear KL Siew,

Certain section of the staff mainly the Executive and the Rank & Files will be effected. The Manager and above under our HQ payroll, therefore their salary especially the GM not effected. Even the HR also not effected. Please advise. Tq

By paying salary not later than the 7th, the company has in fact not violated the Employment Act. This looks like more an internal problem and I think it is best to discuss with your HR including the ways how to improve performance. The HR department should be able to help solving the problems.
