under employment act section 60E(1B), if an employee who is on paid annual leave becomes entitled to sick leave, the employee shall be granted to sick leave, and the annual leave shall be deemed to have not been taken.

My questions is what if we are not covered by employment act, however
1) can we deserve as the above? or
2) the company has the rights to consider it is still under annual leave??

Normally, you produce the MC to HR and have annual leave cancelled. If the company refuses, which companies normally would not do that, then use your medical leave for some other time.
