Re: Overtime Rate for Public Holiday - Security Guard

My Company has 4 guards. 2 are working for day shift and another 2 for night shift based on 12 hours rotating shift schedule. We work 5 days a week. Would appreciate if you could clarify the following:

1) Sat and Sun shall be deemed as overtime work right?
2) If they work on Public Holiday, is this the right calculation:

Example : Work 10 hours
Basic Salary : RM1200

Formula (Less than 8 hours)
= ORP x 2
= 1200/26 x 2 = RM92.30

Formula (More than 8 hours-Balance 2 hours)
= OT hours x 3.0 x Hourly rate of pay
= 2 x 3.0 x [1200/26/8] = RM34.61

10 hours = RM92.30 + RM34.61 = RM126.91

3) My boss said since they work 7 days a week ( Sat&Sun-OT), to get their ORP, their basic salary shall be divided by 30 days instead of 26 days. Is that correct according to Employment Acc 1955?

You boss is not correct. You refer to Section 60I of the EA, the formula for ORP is there.

1. Working normal hours on Saturday and Sunday is 1200/26 x 1 = RM46.15. For overtime after 8 hours 2 x hourly rate

2. Working normal hours on public holidays 1200/26 x 2 = RM92.30. For overtime after 8 hours 3 x hours rate.

thanks. meaning that no 1 and 2 are correct but no 3 is wrong. so i shall be 26 days.

I cannot say because I don't know whether your calculation is for working on rest days or public holidays.
