Scenario 1)

A staff tendered her rsignation letter on 6 January 2010 and written her last day on the letter to be on 5 February 2010 which is a Friday. Our company work on 5 day week. So until when should we pay this staff. Shouldn't she entitled for the Rest day pay which is 6 February a Saturday.

Scenario 2)

Another staff resigned on 14 January 2010 and her last day on her letter is 14 February 2010. Are suppose to pay her up to 14 February which is a Sunday or 13 February 2010. Well our HR insist to pay her up to 12 February which is a Friday.

Tehcnically what is the correct way to calculate the notice of termination is it ONE month noitice oir 30 days notice?

#1 If 5 Feb is the last day, you pay up to that day.

#2 In fact the last day should be 13 Feb. The question whether one month or 30 days, you should look at what is actually written in the contract of service, one month means one month, 30 days mean 30 days..

I have tendered my resignation and my last day will be on 12 Mar 2010. However, the new company willing to paid for my early release penalty. is my current company has the right not to accept my early release?
