Re: Sick Leave (URGENT)

Hi, I have an employee who has worked with us for more than 5 years.
On 1st May 2010 (public holiday) he hurted his leg and was hospitalized for 3 days, with MC from doctor until 15 May 2010 to rest at home.

He returned to the office on 16 May and gave me another MC - until 26 May. As of April 31st he had already taken 5 sick leaves.

How should I treat his sick leave? The 3 days hospitalization should be excluded right? Is he allowed to use up all the 22 days leave even though it's only half way through the year?

I really need to know this urgently! thank you

His continuously ML form 1st May till 26 May is considered as Hospitalization Leave. He is still entitled of 22 days ML per calender year even though this year yet to complete 12 mths. Since he has taken 5 dys ML as at April 2010, ,the hospitalization entitlement (60days) shall be deducted accordingly.

What do you mean by "the hospitalization entitlement (60days) shall be deducted accordingly" ? so 1st may - 26 May shall be deducted from the 60days and not the 22days?

May i also know that which Labour Act specify the 60days hospitalization entitlement? (does it apply automatically when the employee for hospitalized? even for just 3 days?) \

If he has taken 5 dys ML in April then the hospitalization shall left 55 dys per calendar year.

You could refer to S.60F of EA in the even yr employee is fall under the act. Even though he only hospitalized for 3 dys but enough shall be deemed to be hospitalized due to his nature of sickness.
