Mr.Siew , I would like to check whether, a female employee (under month to month contract) who resigned while she is pregnant (8/01/2010) (24 hours) due to the fact that she is constantly unwell, and is now claiming for her confinement benefits?
Is she able to do so, she falls within the ambit of the Employment Act as her salary is RM1,400.00. Please advise.

What is the date of her confinement and how many months she has been in employment?

Her exaact date of confinement i am not aware of but she is employed on a month to month contractual basis.She commenced employment on March 2009, and she informed she was pregnant some where in June 2009.

Come on, she should have given birth by now as it is almost a year. Anyway, she is entitled to maternity benefit.
