Some one told me that if i resign used my annual leave to offset resignation notice, i supposed to work until 21 May but i have 8 days AL so i worked until 11 May.

Shall i get my pay up to 21 May or 11 May?

Let's look at it this way. Annual leave has money value just like money in your pocket. If you want to cut short your notice period, you pay indemnity to the company with your money and in this case with the value of your annual leave balance. So, it should be paid up to 11 May only. In fact under the Employment Act (which covers those with salary not more than RM1500t), an employee is entitled to take his leave before termination takes place.

i have a staff she gave 2 months notice of resignation and her last day supposed is 16th May 2010 but 16th may is Sunday and she only works until 14/5/2010 friday (saturday & sunday off). So her salary we should pay until 14th May (friday) or 16th May (sunday)?

Pay up to 16 May since it is the last day of the notice.

Why our employees was disagreed with the indemnity for their short notice by offset their annual leave balance? he was insisted the company shall pay him up to 21 May. How to handle although clear explanation given to him?
