I employed a Management Trainee 2 weeks earlier. When he just started to work, I told him verbally that he is only able to hold M.T. position if he able to pass the exam after training. This guy din learn properly during his training and unable to sit for exam even I have gave him chances for twice. Can I offer him service crew position instead of M.T with his attitude like this? He has not yet sign for appointment letter

I think you are the one who is in a better position to assess the situation and make the necessary decision. Discuss with the person concerned.

Hi KL Siew, what I mean is actually i did talk to him that due to his attitude during training and unable to pass the exam, I will just offer him service crew position. But he said he will sue us in the labor office as I verbally offer him management trainee position earlier. In this case, am I consider wrong according to the labour law? He had started to work but not yet sign on any appointment letter.

If you ask him to take the lesser position, he will surely complain. The question of his attitude and failing of exam can of course be subject of dispute. If you were to terminate his service, he may complain to the IR Department and apply for reinstatement. If you think he is really not suitable to the job, then you will have to do something about it. Try your best to discuss the problem with him and find a way to end the employment amicably.

Had tried to talk to him but he still refuse to accept and doesnt want to change his attitude. He decided to resign in 24 hours and will not work start from tomorrow.
