Does 12 months contract employment without maternity leave entitlement is legal?

If you are covered by the Employment Act (meaning your salary is not more than RM1500), there will be no problem. You will be entitled to maternity benefit if you fulfilled all the conditions. If you are not covered by the EA, you better have the maternity benefit clause included in your 12 months contract. Otherwise you may not be able to enjoy that benefit.

Dear KL Siew,

If my salary above 5k were not under protection of Employment ACt 1955 right? For the dismissal have to report direct to Industrial Relation ACt ?

I have been worked for the company 7months yet to receive confirmation letter in writing only verbally confirmed. As I have pregnant in 17 weeks, do I still entitled for maternity leave and allowance? As stated in my appointment letter, only confirmed staff are applicable for the company benefit.
