I have queries about MC as I'm actually an accounts clerk but since the company is small I'm the HR too....
My question is... our sales manager (basic salary RM3800), join us less than 2 yrs had a hernia surgery at govt hospital (hospitaliized 3 days) n the hospital gave him MC from 30/3-6/5/2010. How should i calculate his MC? 38 days!!! Does MC include Sat n Sun (We work 5 days/week)

Since he is not covered by the Employment Act, what is his sick leave entitlement based on his contract of service? Go according to the contract of service. Sick leave includes rest days.

In his appointment letter we did mentioned that "Your other terms and condition of service shall be strictly in accordance with Employment Act 1955 amended 1988"
Therefore what should it be?
Pls help me out sa pay day is near.

Sum to say according to the Act his MC is only 14 days + 3 days hospitalized = 17 days MC
He had taken extra 21 days off and I have to deduct it from his pay?

Hospitalization of 60 days mc = staying in the hospital for the whole period of 60 days?

**What puzzle me is that : doctor give MC coz one is unfit to work (my case here is that he had an operation) If he comes office what can he do?
