Hi Mr Siew,
How to calculate termination benefit for a staff who is being paid Fixed Allowance on top of her basic salary? She has been with the company for 6 years
Would the fixed allowance be included to count the termination benefit?
IE Fixed Allowance RM1k, Basic RM3k.
RM4K X 12/365=RM131.51per day X 20 days =RM2630.14 X 6 or
RM3K X 12/365=RM98.63 per day X 20 days = RM1972.60 X 6
Pls advice. Appreciate it. Thanks.

This employee draws a salary of more than RM2000 and therefore he is not covered by the Employment Act/Employment(Termination and Layoff Benefits)Regulations. However, if you still want to use the Act as a guide to calculate payments, your first calculation should be correct.

In reference to this and if the employee is covered under EA, do we need to pay the employee 2 months salary in lieu of the notice ON TOP of the termination/layoff benefit amount for example:-

a)RM2K X 12/365=RM98.63 per day X 20 days = RM1315.10 X 6 =RM 7890.00
or
b)RM2K X 12/365=RM98.63 per day X 20 days = RM1315.10 X 6 =RM 7890.00 + RM2k x 2 months= RM11890.00

Should we follow A or the correct method to follow is B? Thanks

Yes, two months salary as indemnity should also be paid. B is correct.

Hi Mr Siew,
Just wanna check, when we calculate termination benefit, should we include incentive payout as well. Is it incentive payout is part of wages?
Eg :

Total YOS : 6 yrs
Monthly salary : RM1500/permonth
Fixed Allowance: RM300/permonth
Incentive payout : RM200/permonth
RM2K x 12months/365days = RM65.75 x 20days = RM1,315.07 x 6yrs = RM7,890.42

Hi Mr Siew,

I'd issued the letter of termination to all the employees on 21th Jan 2013 and last working day for all employees are on 18th Feb 2013. But when I was issuing the termination letter, one of the employee did not want to acknowledge and receive this termination letter.
So, do i just issue the salary payment including termination benefit to her without her acceptance and signature on the termination letter? 18th Feb is my last business day.

My gross salary is RM4500. Company given 2 months notice only and without any termination benefit.

Please advise this situation can report to labor department and claim back termination benefit?

Hi,may i know if my year of services for company only 1 year 9 month,did i still have the termination benefit?

If yes, how to calculate the termination benefit?
