Re: Sales Commission & Hospitalization Leave

Hi Mr Siew, I have two question need your advice

1. Sales Commission for our company is pay after collection from customer, for eg : May 12 sales customer will pay on Jul 12 (60days term), and the commission will pay to sales man on Aug salary, If the sales man already resigned on Jul, is company still need to pay the commission or not (for May/Jun & Jul sales)? If yes, then need contribute EPF & Socso?

2. One of our staff having Operation on 20.06.12, 3 days at hospital, after that doctor give her MC from 23.06.12 to 27.07.12 (rest at home), how to calculate the MC? Should company give her 3 days hospitalization leave only or 38 days hospitalization leave from 20.06 to 27.07? (Her salary above 2.5k per mth)

1. It depends on your company's policy on payment of commission. If you don't have one, the company should device a suitable payment policy to avoid misunderstanding.

2. She is not covered by the Employment Act, it is for the company to decide based on company's policy. Under the EA, resting at home is considered as ordinary sick leave unless certified otherwise by the doctors that recuperating at home should for some reasons be treated as hospitalisation.
