We had transferred 1 staff to other subsidiary companies, however the staff refuse to accept our transfer. In this case, can we terminate him with 8 weeks notice (works for than 5 years)?

In our Letter of Offer, we stated clause that staff is subject to transfer and the staff had signed the letter.

Would it a problem if we issue termination letter with 8 weeks notice/payment in lieu of notice? as we heard that this staff is going to Labour Office.

Surely he can complain. The Labour Office may have the power to look into the matter and decide as to who is right or who is wrong.
