I am resigning from my job by giving 24 hrs notice. But it had been rejected by my boss.

My contract says that I have to give 3 months notice or I would have to pay back the company.

I have some sales commission's that my company is still holding.

My question here is Can the company deduct that sales commission's amount of money from my 3 month basic salary ?.The rest of the money i am willing to pay after deduction. if they disagree to do this, can They , the company, sue me and take legal actions towards me?

To pay 3 months salary as indemnity in lieu of notice is correct. But I am not sure whether they will pay you the commission. Clarify from the company.
