Re: One month salary in lieu of work

Hi Mr Siew:

One of the staff resign and ask for early release, we grated her one month early departure instead of serving two full months notice period stated in the employment contract.

Are we allow to contra the last month salary that she served to cover the one month early departure request if she refused to compensate the company with a month salary in lieu of work?

It looks like the issue was not properly communicated. When after serving two months notice, she asked for earlier release which was granted, was the qiestion of payment of indemnity properly discussed and agreed upon? If not, there would be a dispute then. Try to resolve the dispute or if not possible, refer the matter to the Labour Office.
