Re: Break of Service for Contract Employee

What is the reason the company is giving a period of break of service while renewing a contract of an employee? The period should at least how many days?

When an employee is employed on yearly contract, some employers want to be careful to avoid employees claiming continuity of service. They normally give a break of one month.

Sir,

What would be the consequences for employees claiming continuity of service?

If that employee is covered by the Employment Act, continuity of service may mean the length of service. Length of service can affect his entitlement for termination benefits, leave and sick leave benefits. Another situation can be when you terminate the service who has been on contract for say 10 consecutive years, and want to claim reinstatement under IR Act.
As to the actual period of break - should it be one month, two months and so on - you may have to do some .research yourselves or consult the Labour Office or other authorities.
