Re: take over of new company

Dear Mr. Siew,

Recently my company has taken over a restaurant and we remain all staff in the restaurant . My question is:-

Do we need to re-issue letter of appointment to all staff?

Yes and the terms and conditions of service should not be less favourable than those the employees were enjoying before. Read up the Employment (Termination and Layoff Benefits)Regulations

If we remain the company name? Just the director and the shareholders will be changed. Do we still need to re-issue the letter of appointment? because the Company name is same and the letter head is same.

I think you better consult your company's legal adviser or your company secretary/accountant or the Labour Department.

Just to share with all the following:-

According to Officer from Labour office, we only need to issue a letter to every staff stated that there is a "CHANGE OF MANAGEMENT and EFFECTIVE DATE" with all the " TERMS AND CONDITIONS REMAIN UNCHANGED". If with the different terms and conditions, just state down on the letter.
