Re: public holiday absent can replace with 2 days annual leave

My driver did not turn up for work today Thaipusam which is one of the public holidays that he must work. can i replace his absent from work with his 2 days annual leave or do I ask him to work on another public holiday

The Employment Act doesn't seem to have anything to say about those suggested by you. Anyway, Thaipusam is a religious festival and many Hindus attach great importance to that occasion to fulfill their vows. If the drivers are Hindus, employers would normally be sensitive about that. Consult the local Labour Department for some official advice.

my driver is a malay. he signed his employment letter and one of the terms was he was given 13 days a year annual leave and thaipusam was not one of them

If Thaipusam is not one of the chosen PH, then it is just absent without leave on a normal working day.
