Dear,

I've been dismissed by company without any reason last month, already file my case into IR office (my salary RM3500/month) for reinstatement. I would like to know, if the company decided to reinstate me, should they pay me back wages for the period of unlawful dismiss? what can I do if the company agreed on reinstatement but no back wages?

Since the case was settled at the IRD level, you should ask the officer about back pay and what if back pay was not given.

I think I have misread your first posting. The case was in fact not yet settled. Now, the next step will be the IRD will call for a meeting for both parties to be present. During the meeting all the questions pertaining to reinstatement will be discussed. At that time, you will know the likely outcome and you will have the opportunity to go into details of what you have in mind. Meanwhile, just wait for the action from the IRD.
