Hi,

I had already pay company for the short notice of 1 mths, and my last day shall be at 16th April.

HR accept the payment, but they say if the management decide to make me stay for another few weeks to complete some tasks, HR will refund to me.

I must start work at 19th April on new company, so I can't stay any longer.
If I choose to leave the company despite they want me to stay, can the HR refuse to pay me salary for 1st April - 16th April? Is legal for them to not to pay me?

p/s: my salary is above 1.5k

Just tell them you can't stay back as you have to take up the new job. I don't see any reason why should they refuse to pay if you had worked during the period.
