I will be 55 at the end of next month. Should I retire voluntarily or wait for my boss to give me a letter. Or if the company should give me letter when is the proper time of notification?

By the way I am working in a small private company.

Is there a retirement age in your appointment letter or is there a written policy about retirement in your company? If there is nothing of that sort and you are still capable of working, you don't go and retire yourself. If you do, you may lose all your rights. Let the company do that if they want to retire you.

I checked my confirmation letter and there is no retirement policy.

If the company issue a letter to me to retire, can I go to industrial court to complain?

I remembered receiving company employment benefits manual in 2007 and have reviewed it. There is a retirement policy clause in that manual.

do I still have the right to go to Industrial Court?

I'm due for retirement as per clause stated in my employment contract. If my co. do issue me a retirement letter, do i entitle for retirement benefits as per clause stated in employment act Termination, Lay-off & retirement benefits 60J(2a).
Pls advise. Thx.
