Re: company cease&maternity benefit

My company plan to cease on sept.My due date is on oct. They try avoid compensate maternity leave to me and give me a choice. I either get off with 1 month pay or work but no maternity compensation. In my appointment letter it stated" upon confirmation a female staff is eligible for full maternity leave period (60)conservative day (inclusive of any gazetted public holiday" . You must complete (6) months continuous service with the company. Now company cease then the above stated is not valid?Kind advise me.

If your salary is not more than RM1500, you are covered by the Employment Act and maternity benefit will not be a problem. However, if you are not covered by the EA but you are already confirmed, there may also not be a problem. If neither, you may have problem in getting your maternity allowance if your company refuses to pay.

I confirmed but they did not issued me a confirmation letter. However I having increment of my pay. That make me headache what if company refuses to pay. What can I do? The company cease and I unable find the related act to refer to.I understand EA is not covered for salary range above rm 1500.They have me refer my appointment letter.
In another words, company can do whatever they like to avoid compensate on the maternity allowance by issuing the lawyer letter or have us type out the resignation letter to avoid involved in EA. That's really sad. Now is Jun and they have me completed the tasks as soon then give me notice to get off. No compensation,no maternity really make me struggle before i confinement. I hope can know more to avoid company do what they like and we get back our right.

Never mind about ceasing operation in September. That may be true or may not be true of what they told you. You just continue working as usual and don't accept their offer for you to get out. If they want to terminate your service, let them do so so that you have grounds to fight.
